Automobile and General Liability Litigation
- The firm has 40 years experience litigating all matters of automobile
and general liability claims in both State and Federal Court on behalf
of insurance carriers such as Travelers, Liberty Mutual, GMAC Insurance
Group, Crum & Forster Insurance, GEICO and AIG (to name only a few).
The nature of the types of cases that the firm has handled over the years
runs the gamut from automobile accidents to DRAM shop liability to State
and multi-district Federal Court defense of the largest dairy cattle dealer
of the eastern United States in multimillion-dollar civil fraud actions.
Insurance No-fault Litigation - The firm, since its inception,
had a specialty in Insurance Law and has advised the insurance industry
in all matter of coverage issues. In addition, the firm has litigated
all matters of insurance coverage litigation, as well as no-fault litigation.
Medical Malpractice Litigation - The firm is extremely selective
in the types of medical malpractice cases it accepts for prosecution.
A thorough medical/legal review is conducted by the firm and, following
same, appropriate cases are reviewed by one of the firm's panel of outstanding
legal medical experts, all of whom are affiliated with prominent teaching
hospitals and medical schools throughout the United States.
Defective Products Liability - The firm has over 30 years
of extensive experience in the field of products liability defense. We
have been privileged to serve as regional counsel for such clients as
Ford Motor Company, A.O. Smith Corporation, Rockwell International and
Chart Industries, Inc. in product liability cases. The nature and extent
of these cases is broad and runs from claimed automobile defects, to power
machinery, to claimed construction claims to anti-tipping warning devices,
to the successful defense of a multimillion-dollar class action claiming
extensive commercial losses due to allegedly defective farm storage equipment.
The partners have offered leading articles and course materials utilized
by the New York State Bar Association for its members in the are of products
liability.
Professional Malpractice (Architectural Engineering, etc.)
- Over the past 25 years, the firm has had extensive experience in defending
architects and engineers in malpractice actions arising out of a broad
variety of construction projects such as sewer districts, prisons and
sky scrapers. The firm has also served as defense counsel in actions alleging
professional malpractice against real estate brokers, insurance brokers,
bank mangers (and even a hairstylist).
General Commercial Litigation - The firm has been involved
in almost every conceivable area of commercial litigation. Real estate
litigation and eminent domain/condemnation matters, commercial contract
disputes, employment contract disputes, liable/slander, claims of unfair
business practices, civil RICO litigation - all have, and continue, to
be a part of the firm's practice and experience. In the '90s, the firm
successfully litigated, in the Federal Court of the United States and
the Civil Courts of the State of Israel, an extensive breach of contract
case with international law issues. The firm has also litigated matters
before the arbitration forums of the New York Mercantile Exchange and
the National Association of Securities Dealers.
Contract/Construction Litigation - In addition to defending
architects and engineers, the firm has also represented, over the years,
numerous contractors in connection with claims relating to construction
projects in both moderate and substantial scope. The firm has also successfully
represented owners of a substantial luxury condominium project against
the developer.
Real Estate - In addition to all manners of real estate
litigation matters, the firm has continued to offer general real estate
services to its broad base of clients.
Civil Rights Litigation - The firm has substantial experience
in prosecuting claims under the section 1983 of the United States Code
and related civil rights and discrimination suits in Federal and State
Court and before the New York State Division of Human Rights.
Trials - The firm's senior partner, Donald D. Brown Jr.,
has recently been recognized by receiving a nomination for membership
in the American Board of Trial Advocates, an elite organization of the
country's top trial attorneys whose membership is based upon selection,
rather than application.
Each of the attorneys in the firm has extensive trial experience, and
each of the partners has tried in excess of 15 jury cases to a verdict.
It is the firm's philosophy that every case should be handled and prepared
as though it is going to be tried to a conclusion. While a majority of
litigated matters never reach the point of a jury verdict, it has been
the firm's experience, over its many years of practice, that the best
settlements are achieved by being fully prepared to take the case to its
conclusion.
Appeals - The firm has broad and extensive experience in
handling and arguing civil appeals in a vast variety of cases. The partners
in the firm have argues appeals before the Federal Circuit Court of Appeals,
the Court of Appeals of the State of New York, as well as the Appellative
Divisions. Mr. Brown and Mr. Spiegel are admitted to practice before the
Supreme Court of the United States.
The firm's attorneys have extensive backgrounds in legal research and
writing. Several of the partners were editors of their Law Reviews and
have published scholarly writings in matters related to civil litigation.
Mr. Brown is a former Confidential Law Assistant for the Justices of the
Appellate Division, Third Judicial Department.
The firm, in addition to its significant experience in handling appeals
for its own clients, has long enjoyed relationships with other attorneys
who continue to refer their appellate matters to the firm for handling.
